摘　　要：在专利权获权程序中,采用功能性限定技术特征的撰写方式可以使专利权保护范围最大化;在专利权侵权认定程序中,等同技术特征的认定可以将被认定为是等同技术特征的技术特征纳入专利权的保护范围内。文章结合司法案例,对含有功能性限定技术特征的专利权保护范围的界定和等同技术特征对专利权保护范围的影响进行了探讨。In the process of obtaining patent rights,the use of functional technical features can maximize the scope of patent protection.In the process of patent infringement,the identification of equivalent technical features can be taken into the scope of patent protection.This article discusses the definition of the scope of patent protection with the functional technical features and the impact of equivalent technical features on the scope of patent protection based on a judicial case.
