摘　　要：通过对保密审查专利无效案件的案例检索和信息分析,探讨了保密审查无效条款在专利无效案件中的审查方向及难点。研究发现,涉及保密审查条款的无效案件复杂程度相对较高,平均每个案件涉及约19.9份证据,且45%的案件中专利权人使用了反证,平均证据数量和反证应用比例均远高于普通案件。该类案件中,为了论证发明创造的完成地和保密审查的合规性,使用了大量非专利证据,其中81%的案件使用了非专利证据,占总证据的53.46%。此外,66.67%的案件还涉及其他无效条款,其中创造性条款的应用比例达到61.90%,说明无效宣告请求人往往将保密审查无效条款与其他无效条款组合使用,以构建更全面和更有力的专利无效策略。This study explores the examination direction and challenges of the confidentiality examination invalidity clause in patent invalidation cases through case retrieval and information analysis.The research finds that cases involving the confidentiality examination clause are relatively more complex,with an average of about 19.9 pieces of evidence per case,and 45% of the cases involving the use of counter-evidence by the patentee.Both of the two numbers are significantly higher than in typical cases.In these cases,a large number of non-patent evidence is used to argue the place where the invention was completed and the compliance of the confidentiality examination,with 81% of the cases using non-patent evidence,accounting for 53.46% of the total evidence.Additionally,66.67% of the cases involve other invalidation clauses,among which the application proportion of the inventive step clause reaches 61.90%.This indicates that invalidation requesters often combine the confidentiality examination invalidation clause with other invalidation clauses to construct a more comprehensive and powerful patent invalidation strategy.
