超长权利要求的创造性评述方法的研究

摘　　要：针对部分专利申请存在权利要求冗长且创造性高度不高的问题,提出一种基于超长权利要求的创造性评述的方法:首先确定超长权利要求所属的类型,之后根据不同的类型采用各自对应的评述方式进行创造性评述。通过实际案例表明,该方法可以针对不同类型的超长权利要求灵活选取相应的评述方法,有效避免了审查员割裂技术方案和遗漏技术特征的问题,在提高审查效率的同时,也能保证审查质量,还能使创造性评述的整体结构更加清晰严谨,有助于提高审查意见通知书的效能。Aiming at the problems of lengthy claims and low inventiveness in some patent applications,this study proposes a method for evaluating inventiveness based on super-long claims.Firstly,the method determines the type of super-long claims.Then,it applies corresponding evaluation methods based on the different types to conduct inventiveness evaluation.Practical cases show that this method can flexibly select appropriate evaluation methods for different types of super-long claims,effectively avoiding examiners splitting technical solutions and missing technical features.This method also improves the efficiency of examination while ensuring the quality of examination,simultaneously makes the overall structure of inventiveness evaluation clearer and more rigorous,and enhances the effectiveness of examination notification.
