摘　　要：算法歧视及其危害引起了国内外各界的高度重视,公众参与算法歧视治理由此兴起。公众参与算法歧视治理在一定程度上实践了芬伯格“设计批判”民主化思想,尤其自下而上方式的公众参与算法歧视治理,不仅是技术治理的直接民主模式,而且提供了具体考察和推进技术民主化实践的良好契机。公众参与算法歧视治理直面算法开发和算法审计的上游,故天然具有民主性质。尽管算法歧视治理的民主化较初步,但将来有望揭开人类技术民主政治新的一页。要警惕算法滥用对民主政治等的重大危害,务必将算法歧视治理纳入民主范畴;应促进自上而下方式和自下而上方式的结合,加强算法开发者和公众之间的沟通与信任,借此构建一种基于协商民主的公众参与算法歧视治理,推动算法歧视治理民主化向纵深发展。Algorithm discrimination and its harm have aroused great attention at home and abroad,and public participation in algorithm discrimination governance has emerged.To a certain extent,the discriminatory governance of public participation algorithm practices Feinberg's‘design criticism'democratization thought,especially the bottom-up discriminatory governance of public participation algorithm not only practices the direct democratic mode of technology governance,but also provides a good opportunity to specifically examine and promote technology democratization.Public participation algorithm discrimination governance faces the upstream of algorithm development and algorithm audit,so it is naturally democratic.Although the democratization of algorithmic discriminatory governance is still relatively preliminary,it is expected to open a new page in human technological democracy in the future.We should be alert to the great harm of algorithm abuse to human democracy,and must bring algorithm governance into the category of democratization.The combination of top-down approach and bottom-up approach should be promoted to strengthen the communication and trust between algorithm developers and the public,so as to build a public participation algorithm discrimination governance based on consultative democracy,and promote the democratization of algorithm discrimination governance to develop in depth.
