摘　　要：农村集体经济组织成员资格的认定存在困境,成员权的行使状况亟待优化。在明确农村集体经济组织成员与农民集体成员身份同一性,厘清成员与股东、村民之间关系的基础上,显化成员权的私法属性,阐明其必然受团体法调整的法理逻辑。随着《农村集体经济组织法》的颁布与实施,应规范界定成员的基本内涵,建立成员身份的动态调整机制,优化并完善成员权保护机制,从制度层面畅通成员权保护的法治路径,实现成员权保护的体系化与规范化。The recognition of membership qualifications in rural collective economic organizations faces numerous difficulties in practice,and the exercise of members′rights urgently needs to be optimized.Therefore,it is necessary to highlight the private law attributes of membership rights and elucidate the legal logic that they are inevitably regulated by group law,based on clarifying the identity unity between members of rural collective economic organizations and collective members of farmers,as well as distinguishing the relationships among members,shareholders,and villagers.With the promulgation and implementation of the Rural Collective Economic Organization Law,it is essential to standardize the definition of the basic connotation of membership,establish a dynamic adjustment mechanism for membership status,optimize and improve the protection mechanism for membership rights,and smooth the legal path for membership rights protection at the institutional level,thereby achieving systematization and standardization in the protection of membership rights.
