从《庚辛提牢笔记》看清末狱制改良

摘　　要：清人白曾焯所作《庚辛提牢笔记》记录了从庚子年到辛丑年这段时间清末狱制改良实践的历史样态。在这个时间段里,以收回“领事裁判权”为契机,改良推动者以西方监狱制度为摹本,推行监狱改良。《庚辛提牢笔记》以最直观、最真实的笔触将这一时间段内的清末狱政情况进行客观的记录,可以看到改良推动者一方面对中国传统监狱治理理念执着的恪守,另一方面面对着瞬息万变的社会现实又必须做出无奈的转变。无论如何,在客观上这一变化推动了中国近代监狱制度改革的进程。Bai Zengzhuo,a Qing Dynasty scholar,recorded the historical situation of the reform and practice of the prison system in the late Qing Dynasty from the year of Gengzi to the year of Xinchou in his Notes on Gengxin Prison.During this period,taking the opportunity of revoking theconsular jurisdiction",advocates for reform took the Western prison system as a model and implemented prison reforms.Notes on Gengxin Prison objectively records the situation of prison administration in the late Qing Dynasty during this period with the most intuitive and realistic strokes.It can be seen that the promoters of reform were persistent in adhering to traditional Chinese prison governance concepts,but at the same time they had to make helpless changes in the face of rapidly changing social realities.In any case,objectively speaking,this change has driven the process of reforming China's modern prison system.
