摘　　要：2023年4月27日发布的“欧盟标准必要专利(以下简称SEP)新提案”开启了“专门机关监管”这一SEP治理的新模式:通过建立行政监管机关、强制注册制度、总许可费率确定制度、“必要性”检查制度等对SEP进行治理。与之前已经存在的法院治理模式、反垄断机关治理模式、标准组织治理模式等相比较,其突出特点在于强调专门机关在SEP治理中的“行政性强监管”。该新模式既具有促进SEP治理创新、增加SEP交易的透明度、维护SEP的质量、提高SEP交易效率等积极作用,也存在过度监管可能抑制SEP市场活力并影响创新、选择性监管可能导致SEP权利人与实施者利益不平衡、增加SEP诉讼的行政前置程序可能弊大于利、职能中心直接干预具体交易价格可能扭曲SEP市场价格机制等不足之处。在全球SEP竞争日益激烈的国际背景下,对该新模式的深入研究与全面探讨,有利于加快推动建立既适合中国国情又反映世界趋势的中国SEP治理模式。The new European Union SEP proposal published on April 4,2023 opens a new model for the governance of the standard essential patent(SEP),which is the regulation of specialized authorities:the governance of SEP through the establishment of an administrative supervisory authority,a compulsory registration system,a general licensing rate determination system,and a“necessity”inspection system.Compared with the existing models of court governance,anti-monopoly authority governance and standard organization governance,its outstanding feature is to emphasize the“strong administrative supervision”of specialized agencies in SEP governance.The new model has positive effects on promoting SEP governance innovation,increasing the transparency of SEP transaction,maintaining the quality of SEP,and improving the efficiency of SEP transaction.However,there are also some deficiencies,such as excessive regulation may inhibit the vitality of SEP market and hinder innovation,selective regulation may lead to the imbalance of interests between SEP right holders and implementers,increasing the administrative pre-procedures of SEP litigation may do more harm than good,and direct intervention by the Competence Centre in specific transaction prices may distort the market price mechanism of SEP.In the context of increasingly fierce global competition in SEP areas,in-depth study and comprehensive discussion of this new model is conducive to accelerating the establishment of a Chinese SEP governance model that is suitable for China's national conditions and reflects the world trend.
