民商法制度在电子商务中的发展空间与运用措施

摘　　要：电子商务作为信息技术发展的产物,已经深刻改变了现代商业的运作模式和人们的消费习惯。从最初的简单在线购物,到如今的多元化电子商务生态系统,电子商务的迅猛发展不仅推动了市场经济的快速增长,也对传统的法律体系提出了新的要求。民商法作为维护市场经济秩序的重要法律基础,其能否适应电子商务的特殊需求,为电子商务发展提供法律保护是当下法学研究的重点课题。基于此,本文首先分析了民商法在电子商务领域的应用模式,深入剖析了电子商务的发展现状以及民商法制度存在的缺陷,从而进一步明确完善主体审定制度、引入WTO规则等具体发展方向,并提出加强主体审定实施力度、完善相关配套措施等民商法运用建议,以期为电子商务的健康发展提供法律保障,从而进一步推动民商法制度的创新与完善。E-commerce,as a product ofthe development of information technology,has profoundly changed 1the operation modes of modern business and people's consumption habits.From the initial simple online shopping to today's diversified e-commerce ecosystem,the rapid development of e-commerce has not only driven the rapid d growth of the market economy but also posed new demands on the traditional legal system.As an important legal foundation for maintaining the order ofthe market economy,whether civil and commercial law can adapt tothe especial needs of e-commerce and provide legal protection for its development is a key topic in current legal research.I Based on this,this paper first analyzes the application models of civil and commercial law in the field of e-commerce,delves into the current development status of e-commerce,and examines the deficiencies in the civil and commercial law system.This analysis further clarifies specific directions for development,such as improving the esubject qualification system and introducing WTO rules.Additionally,the paper proposes suggestions for enhancing the implementation of subject qualification and establishing relevant supporting measures in the application of civil Iand commercial law.The aim isto provide legal guarantees for the healthy development of e-commerce,thereby further promoting the innovation and improvement of the civil and commercial law system.
