摘　　要：公共数据资源授权运营是依法持有公共数据资源的机构,按照法律法规和相关要求,授权符合条件的运营机构进行治理、开发,并面向市场公平提供数据产品和技术服务的活动。2025年3月1日起,由国家发展改革委和国家数据局公布的《公共数据资源授权运营实施规范(试行)》(以下简称《实施规范》)正式施行。《实施规范》从基本要求、方案编制、协议签订、运营实施、运营管理五个方面,明确了公共数据资源授权运营工作的决策流程、实施路径和管理要求。由于《实施规范》是一项创新性的数据产权制度,备受社会关注和期待,亟须在法律和政策层面进行宣传解读,并在法治和政策体系保障下实施,本文重点就《实施规范》中涉及的政策执行和法律规则适用作具体解析。Authorized operation of public data resources refers to the activity where institutions legally holding public data resources authorize qualified operating entities to manage,develop,and provide data products and technical services to the market in accordance with laws,regulations,and relevant requirements.Starting from March 1,2025,the"Implementation Specifications for Authorized Operation of Public Data Resources(Trial)"(hereinafter referred to as the"Implementation Specifications"),jointly issued by the National Development and Reform Commission and the National Data Administration,will come into effect.The"Implementation Specifications"stipulates the decision-making process,implementation pathways,and management requirements for the authorized operation of public data resources from five aspects:basic requirements,plan formulation,agreement signing,implementation,and management.As the"Implementation Specifications"represents an innovative data property rights system,it has garnered significant attention and anticipation from the public.Therefore,there is an urgent need for its interpretation and promotion from the legal and policy perspective,as well as its implementation on the track of rule of law.In this context,this article makes a detailed analysis of the application of policies and rules involved in the"Implementation Specifications."
