六尺巷“和”文化背景下新就业形态用工纠纷调解制度的完善

摘  要:多部门对新就业形态用工纠纷的调解可以汲取安徽省六尺巷“和”文化的精髓,新就业形态的调解制度值得关注。当下仲裁或诉讼前的调解制度不合理、劳动关系认定标准不统一,不利于当事人劳动争议的调解,导致仲裁或诉讼前的调解难以有效息讼止争。应扩大调解组织范围,将部分争议调解设定为仲裁或诉讼的前置程序,就工会、劳动监察等组织力量提前介入出台探索性规定;结合不同岗位劳动关系认定,建立具有过渡性质的参考清单;科学设置调解时间,填补调解协议方面的规则空白,完善程序规则;按照“分步走”“递进式”的完善思路,在法律政策层面强化支撑保障力度。The multi-departmental policy documents on mediation of labor disputes in new employment forms are highly consistent with the concept of"Harmony"culture in the Lane of Courtesy,Anhui Province,and the mediation system of such new employment forms deserves more attention due to the weak efforts in academic research and institutional practice.Due to the unreasonable mediation system before arbitration or litigation,inconsistent standards for determining labor relations,unfavorable procedural provisions,unclear positioning of mediation institutions,and insufficient integration of mediation forces,the relevant institutional provisions are not compatible with the culture of"harmony",which makes it difficult for mediation before arbitration or litigation to effectively absorb disputes and contradictions.In this regard,it is suggested to expand the scope of mediation organizations,set some dispute mediation as the preliminary procedure of arbitration or litigation,and issue exploratory provisions on the early intervention of labor unions,labor inspection and other organizational forces;Establish a transitional reference list based on the identification and judgment of labor relations in different positions;Set the mediation time by type,fill in the rule gaps in mediation agreement and improve the procedural rules according to the quality of mediation agreement,performance guarantee and unperformed arbitration litigation system.In accordance with the"step-by-step"and"progressive"improvement ideas,we will strengthen the support and guarantee efforts at the legal and policy levels.
