摘　　要：AI生成演员是完全或者辅助由AI工具所生成的数字演员,但其可版权性问题制约其进一步的影视应用。为此,有必要厘清AI生成演员与相关概念的异同以及独创性判定标准,进而适用该标准对AI生成演员的角色肖像、表演所生成的连续画面作为分析对象,从生成技术、剧情设定、镜头画面等方面分析其独创性。同时,仅撰写描述性文字后AI自动生成的成果等缺乏“最低限度的创造性”的内容,以及思想、公有领域的知识成果剔除出保护范围。AI-generated actors are digital actors that are either fully or partially generated by AI tools but the issue of their copyrightability restricts their further application in the film and television industry.Therefore,it is necessary to first clarify the similarities and differences between AI-generated actors and related concepts,as well as the criteria for originality determination.Then,apply this standard to analyze the character portraits and the continuous images generated by their performances as the objects of analysis,and examine their originality from aspects such as generation technology,plot setting,and camera shots.At the same time,the results automatically generated by AI after only writing descriptive text and other contents lacking the“minimum level of creativity”,as well as ideas and knowledge in the public domain,should be excluded from the scope of protection.
