健康医疗数据共享中的权益冲突要因及应对方案探析

摘　　要：健康医疗数据共享对个人信息权益保障体系提出了更高的要求,共享路径上亟需重新审视医疗特定视域下错综复杂的利益诉求,讨论健康医疗数据共享中主体、客体和内容中的共享堵点;在提升数据共享质量上应以权益冲突为抓手,针对健康医疗数据的特殊属性,从公共利益、经济利益和隐私保护视角确立其安全监管规则,提升隐私保护的协同化水平。Health and medical data sharing puts forward higher requirements for the protection system of personal information rights and interests;In terms of sharing path,it is urgent to re-examine the intricate interest demands under the specific medical perspective,and discuss the sharing blocking points in the subject,object and content of health and medical data sharing.In terms of data sharing quality,conflicts of rights and interests should be taken as the starting point.In view of the special attributes of health and medical data,security regulatory rules should be established from the perspective of public interests,economic interests and privacy protection to improve the level of coordination of privacy protection.
