将中药饮片纳入《中药品种保护条例》规制中的利益衡量研究

摘　　要：将中药饮片纳入《中药品种保护条例》规制可识别利益相关者的诉求并进行利益衡量;探讨分析了中药饮片品种保护中核心利益相关者的诉求及其共同利益与利益冲突,认为造成冲突的原因是各利益相关者对秩序价值与自由价值、效率价值与公平价值、整体利益与局部利益的选择有所不同,故提出应以公共利益优先、私人利益填补和各项利益统筹兼顾的原则指导中药饮片品种保护政策的制定。The inclusion of TCM decoction pieces in the Regulations on the Protection of TCM Varieties can identify the demands of stakeholders and measure the benefits.This paper discusses and analyzes the appeals of core stakeholders and their common interests and interest conflicts in the protection of TCM decoction pieces varieties,and believes that the reasons for the conflicts are different choices between order value and freedom value,efficiency value and fair value,overall interest and partial interest.Therefore,it is suggested that the principle of giving priority to public interests,filling in private interests and taking all interests into consideration should guide the formulation of the protection policy of TCM decoction pieces.
