摘　　要：职场监控作为用人单位用工管理权的表现形式之一,蕴含着用人单位用工管理权和劳动者权益的对抗冲突,技术的发展又赋予了职场监控智能属性,导致了诸多劳动者权益保护困境。智能监控实施较为集中的场景可分为工作空间与非工作空间、工作设备与个人设备两大类,为了确保智能监控的合理运用,需要明确界定合理区域,前者需要重视的必要性以及目的—手段的均衡性审查,后者则应强调知情同意原则。实践层面还需要通过构建以劳动基准法为重点的规范体系,落实个人信息保护原则在劳动场景的应用,同时建立行政监管和行业自律协同的监督机制,实现用人单位监督管理和劳动者权益保护的动态平衡。As one of the manifestations of the employer′s employment management right,workplace monitoring contains the confrontation and conflict between the employer′s employment management right and the rights and interests of workers;the development of technology has endowed workplace monitoring with intelligent attributes,resulting in many dilemmas in the protection of workers′rights and interests.The scenarios where the implementation of intelligent monitoring is more concentrated can be divided into two categories,which are workspace and non-workspace and work equipment and personal equipment.In order to ensure the rational use of intelligent monitoring,it is necessary to clearly define the reasonable area;the former needs to pay attention to the necessity of the purpose and the balance of the end and the means,and the latter should emphasize the principle of informed consent.At the practical level,it is also necessary to implement the application of the principle of personal information protection in the labor scene by building a normative system focusing on the Labor Standards Law,and at the same time establish a supervision mechanism for administrative supervision and industry self-discipline and coordination,so as to achieve a dynamic balance between the supervision and management of employers and the protection of workers′rights and interests.
