摘 要:在海事执法实践中,部分海事行政处罚案件对于当事人的责任认定、违法情节认定等有着较大争议,其中对于船长具有双重身份的责任认定具有代表性。某船员在一艘货轮担任船长职务,同时又是船舶的所有人之一,在此情形下,对于船舶发生的违法行为,适用“一事从重”的原则进行处罚,还是适用“并罚”原则对船舶所有人、船长同时进行处罚存在争议。因此,结合海事调查工作经验,基于船长双重身份对违法责任进行分析讨论。In the practice of maritime law enforcement,there are some cases of maritime administrative punishment in which great disputes exist concerning the identification of the liabilities of the parties and the circumstances of violations.For example,a typical dispute centers on the liability identification of the captain with dual identities.In a case where a crew member acting as the captain of a cargo ship is also one of the shipowners,for the violations of the ship,controversies may arise on whether to apply the principle of"choosing the heavier punishment"or the principle of combined punishment to punish the shipowner and the captain at the same time.Based on the experience in maritime investigation,the author probes into the liabilities of violations based on the dual identities of the captain.
