摘 要:《中华人民共和国海上交通安全法》(以下简称《海安法》)修订前,水上交通事故调查及责任认定行为是否可诉,各方观点不一。从行为属性、影响后果以及权力救济角度分析,水上交通事故调查及责任认定行为不可诉为宜。修订后《海安法》第八十五条规定,海上交通事故责任认定书作为证据,对统一各方认识,促进水上交通事故调查工作有积极意义。当前,水上交通事故调查及责任认定不可诉,故海事部门需继续完善水上交通事故调查相关工作机制,公平公正定责,加强当事人合法权益保护,服务航运高质量发展。Before the revision of the Maritime Traffic Safety Law,opinions differ on whether litigation can be brought against the investigation and liability identification of maritime traffic accidents.Based on analysis from the perspectives of attributes of action,impact consequences,and power remedies,the investigation and liability identification of maritime traffic accidents should not be subject to litigation.Article 85 of the new Maritime Traffic Safety Law stipulates that the report of identification of liability for the maritime traffic accident shall be used as the evidence for handling the accident,which is of positive significance to unify the understanding of all parties and promote the investigation into maritime traffic accidents.Presently,the investigation into maritime traffic accidents and the liability identification are not actionable,therefore,the maritime administration should continue to improve the work mechanism of maritime traffic accident investigation,determine liabilities in a fair and just manner,strengthen the protection of the legitimate rights and interests of the parties,and serve the high-quality development of the shipping industry.
