摘　　要：独立合同人是国际海上货物运输中的重要主体,其法律概念源自英美法并被不少国际海上运输公约吸收,然而国内立法及相关领域研究尚在起步阶段。在《中华人民共和国海商法》修订之际,从独立合同人的法律概念、历史渊源、界定标准出发,明确其法律地位,并且提出相关章节的修订建议,为我国海运事业的健康发展提供助力。The independent contractor is an important subject in international maritime cargo transportation.Its legal concept originated from Anglo-American law and has been absorbed by many international conventions on maritime transportation.However,domestic legislation and related research are still in the initial stage.On the occasion of the revision of the Maritime Law of the People's Republic of China,this article starts from the legal concept,historical origin and definition standards of the independent contractor clarifies its legal status,and puts forward revision suggestions for relevant chapters of the Maritime Law,aiming to provide assistance for the healthy development of China's maritime transportation industry.
