摘　　要：随着人工智能等信息技术快速创新,网络谣言治理这类老问题开始出现“新情况”:算法推荐促使网络谣言信息的误导性加强;深度合成技术提升了网络谣言“无中生有”的能力;网络黑灰产的链条化加剧了网络谣言的社会危害性。这些“新情况”使得传统的网络谣言治理机制开始失效,故而需要动态调整网络谣言治理逻辑和治理框架。在治理逻辑层面,网络谣言的治理并非意在彻底根除网络谣言,而是最大化地削弱网络谣言的社会危害性,故而相应的治理机制应当围绕限制网络谣言的传播能力予以展开,亦即“以真相倾轧假象”。这种基于信息传播规律的治理逻辑也延伸出三种分别面向“信息传播节点”“信息受众”和“信息传播全过程”的治理方向,分别对应刑事责任追究、平台算法推荐优化、网络软法动态调整等具体治理机制。With the rapid innovation of information technologies such as artificial intelligence,old issues like online rumour governance has begun to emerge.For instance,algorithmic recommendation has strengthened the misleading of online rumour information,in-depth synthesis technology has enhanced the ability of online rumour to“create something from nothing”,and the chaining of network black and gray industries has aggra-vated the social harm of online rumour.Under these“new issues”,the traditional mechanism of online rumour governance becomes ineffective,so it is necessary to dynamically adjust the logic and framework of online rumour governance.At the level of governance logic,the governance of online rumour is not intended to com-pletely eradicate online rumour,but to maximally weaken their social harm.Therefore,the corresponding gov-ernance mechanism should be developed around limiting the dissemination capacity of online rumour,i.e.,“tipping falsehoods with truth”.This governance logic based on the law of information dissemination also extends three kinds of governance orientations for“information dissemination nodes”,“information audience”and“the whole process of information dissemination”,respectively.They correspond to specific governance mechanisms such as criminal responsibility,platform algorithm recommendation optimization,and dynamic adjustment of internet soft law.
