摘 要:留守儿童罪错行为的应对机制应构建于罪错发生机理和惩教资源现状,以罪错承担为基础,以矫治教育为导向。针对理论研究和实践运行中罪错应对的惩教偏向性问题,应基于行为归因理论,树立“以教为基、教惩并重”理念,在罪错承担上确立司法化及类司法化追责机制;为补足留守儿童家庭管教的不足和学校管教的乏力,应通过“国家政策鼓励,地方财政支持,基层后续供给,社会积极参与”的模式,明确家庭社会工作服务的罪错管教功能;基于罪错行为的成因,解决罪错问题,需建构政府保障,“家校社”一体化联动应对机制,确立灵活的家、校、社联动机制;还需完善矫治惩罚与教育保护的双轨融合与衔接机制,切实扭转实践中的价值偏向。The coping mechanism of delinquent behaviors of left-behind children should be built on the occurrence mechanism of crime and the current situation of correctional resources,based on the responsibility of crime and guided by correction education.In response to the problem of the punishment and correction bias in dealing with delinquent behaviors in theoretical research and practical operation,based on the theory of behavioral attribution,the concept of“taking education as the foundation and attaching equal importance to education and punishment”should be established,and a judicial and quasi-judicial accountability mechanism should be established for on the responsibility of crime.To make up for the insufficiency of family discipline and the ineffectiveness of school discipline for left-behind children,the function of delinquency discipline in family social work services should be clarified through a model of“national policy encouragement,local financial support,grassroots follow-up supply,and active social participation”.Based on the causes of delinquent behavior,to address the issue of delinquency,it is necessary to construct a government-guaranteed,integrated linkage response mechanism among“family,school and society”,and establish a flexible family-school-society linkage mechanism.It is also necessary to improve the dual-track integration and connection mechanism of correctional punishment and educational protection,and effectively reverse the value bias in practice.
