生态项目建设区农用地“只征不转”的实践价值及完善路径——基于成都环城生态核心区实地调查

摘　　要：近年来,成都市由于现行土地利用现状分类体系中没有生态用地这一用途,使生态建设项目区域内土地利用、产业发展以及农民的选择都缺乏相应的法律支撑。本文基于成都市成华区环城生态区所辖范围的白莲池街道与龙潭街道农用地“只征不转”的试点工作,从理论和实践层面探讨生态保护区农用地“只征不转”政策依据、现实逻辑以及完善空间,试图在当前把“生态环境保护放在更加突出的位置”的背景下,对解决生态文明项目建设区非拆迁项目农民的后顾之忧、兼顾保护与发展工作有所裨益。In recent years,due to the absence of an"ecological land"category in China's current land use classification system,land use,industrial development,and farmers'choices within ecological project areas in Chengdu have lacked proper legal support.Based on a field study of the pilot implementation of the"expropriation without land use conversion"policy for agricultural land in the Bailianchi and Longtan subdistricts of the Chengdu Ring Ecological Zone,this paper examines the policy basis,practical logic,and potential improvements of this approach.From both theoretical and practical perspectives,it explores how this policy can address the concerns of farmers in non-relocation ecological projects while balancing ecological protection and development,in the broader context of prioritizing ecological conservation.
