摘　　要：成渝地区数据治理法律框架的构建是一项系统而复杂的工程。其涵盖了治理责任、数据权利和数据安全等多个维度,并紧密关联区域的法治需求。在构建逻辑上,坚持合法性、正当性、透明性和责任性原则。从宏观架构到微观操作层面,层层递进,逐步细化,确保区域法律框架的完整性和可操作性。在核心制度设计上,聚焦于区域数据权益保护、数据安全监管和数据共享开放等制度,旨在保障数据主体的权益,维护数据安全,并推动数据的合理利用和共享。为进一步推进这一区域性工程,需强化成渝两地的政策引导与立法规划,注重跨部门的协同与资源整合,明确数据治理的目标和原则,打破部门壁垒,形成制度合力,推进具体、协同的政策措施。此外,要进一步关注技术创新对法律框架的影响,不断提升技术水平,确保法律框架与技术发展相适应。The construction of a legal framework for data governance in the Chengdu-Chongqing region is a systematic and complex project.It encompasses multiple dimensions,including governance responsibilities,data rights,and data security,closely aligning with the region’s legal and regulatory needs.The construction logic adheres to the principles of legality,legitimacy,transparency,and accountability,progressing from a macro framework to micro-level implementation to ensure both comprehensiveness and operability.The core institutional design focuses on regional data rights protection,data security regulation,and data sharing mechanisms,aiming to safeguard data subjects'rights,maintain data security,and promote the rational use and sharing of data.To further advance this regional initiative,it is essential to strengthen policy guidance and legislative planning between Chengdu and Chongqing,clarify the objectives and principles of data governance,and implement concrete,coordinated policy measures.Additionally,attention must be given to the impact of technological innovation on the legal framework,continuously enhancing technological capabilities to ensure alignment between legal structures and technological advancements.
