治理现代化背景下非法行医犯罪刑事治理机制优化研究——以近五年江苏省刑事审判数据分析为基础

摘　　要：文章以近五年江苏省非法行医犯罪刑事判决为基础,分析非法行医犯罪主客观特征,探究犯罪影响因素。结果显示:非法行医犯罪与医疗服务可及性不足相关;部分非法行医行为有历史原因,行政治理有待优化;该省非法行医刑事司法贯彻了轻刑化政策,认罪悔罪较为普遍;非法行医刑事司法起到了防范公众健康安全风险的效果,实现了应有的治理功能。研究认为:应当进一步规范非法行医审判的定罪量刑,优化行刑衔接,提升刑事司法的非法行医犯罪预防效果;优化行政执法,以行政治理助力非法行医犯罪预防;重视公众参与,推进非法行医犯罪社会共治;进一步优化医疗资源配置,强化非法行医犯罪源头治理。Based on the criminal judgments of illegal medical practice in Jiangsu Province in the past five years,the subjective and objective characteristics of crimes of illegal medical practice were analyzed,and the factors to influence the crimes were explored,which showed that the crime of illegal practice of medicine was related to the lack of accessibility of medical services.Some illegal practice of medicine had historical reasons.And the administrative governance needs to be optimized.The criminal justice of illegal practice of medicine in this province has carried out the policy of lighter sentences,and guilty pleas and repentance were more common.The criminal justice of illegal practice of medicine in this province has prevented the risk of public health and safety,and realized the governance function.It is suggested to further standardize the conviction and sentencing of illegal medical practice trials,and optimise the linkage between execution and punishment,so as to enhance the effectiveness of criminal justice in preventing illegal medical practice,optimise the administrative law enforcement so as to assist in the prevention of illegal medical practice,value the public participation so as to promote the social co-governance of illegal medical practice,and optimise the allocation of medical resources so as to strengthen the governance of illegal medical practice.
