黄河流域环境执法的协同困境与优化路径

摘　　要：黄河流域生态保护和高质量发展的国家战略背景下,研究黄河流域环境执法协同具有必要性和可行性。目前,黄河流域环境执法协同困境主要体现在执法依据和裁量标准不统一,双重管理下的执法体制与流域整体性存在张力,执法协同的实效性差,执法协同受地方利益影响较大等。建议通过加快推进跨区域协同相关立法,建立健全联合执法的长效机制,提升执法协同的实效,强化联合执法监督等优化黄河流域环境执法。Under the national strategy for ecological protection and high-quality development of the Yellow River Basin,studying the coordination of environmental law enforcement in the Yellow River Basin is necessary and feasible.Currently,the dilemmas in the coordination of environmental law enforcement in the Yellow River Basin are mainly reflected in the following aspects:inconsistent enforcement basis and criteria for discretion,tension between the law enforcement system under dual management and the integrity of the river basin,poor effectiveness of law enforcement coordination,and significant influence of local interests on law enforcement coordination.It is recommended to promote law enforcement coordination through cross-regional collaborative legislation,establish and improve a long-term mechanism for joint law enforcement,enhance the effectiveness of law enforcement coordination,and strengthen the supervision of joint law enforcement.
