电力架空输电线路用地问题的思考——基于公共地役权的视角

摘　　要：电力作为国民经济发展的重要支撑,在现代社会生活中发挥着重要作用。随着电力需求的增加,电力企业与土地使用权人之间的纠纷也越来越多。在现行的法律制度下,电力企业与土地权利人之间存在地役权成本高于效益、设立空间权难以实行以及相邻关系不适用等诸多矛盾。公共地役权在取得方式、性质及功能等方面非常契合电力企业用地问题,在解决电力企业架空输电线路用地困难方面具有显著作用。鉴于此,文章在探讨现行法律制度困境的基础上,提出引入公共地役权制度解决现有法律困境的建议,并分析引入公共地役权可能存在的问题及风险,为更好地平衡公共利益与私人利益之间的关系进行了有益思索。As an important support for the development of the national economy,electric power plays a crucial role in modern society.With the increase in electricity demand,disputes between power companies and land use right holders have also increased.Under the current legal system,there are many contradictions between power enterprises and land right holders,such as the cost of easements being higher than the benefit,the difficulty of establishing space rights,and the inapplicability of adjacent relationships.Public easements are very suitable for the land use problems of power enterprises.In terms of acquisition methods,their nature,and functions,they play a significant role in alleviating the dilemma of land use for overhead transmission lines of power enterprises.In view of this,on the basis of exploring the dilemma of the current legal system,this paper puts forward a proposal to introduce a public easement system to solve the existing legal dilemma.
