摘　　要：新疆仲裁事业整体发展不充分,未能有效发挥支撑新疆自由贸易试验区良性运转的保障作用。结合新疆实际以及国内其他地方仲裁发展实践,建议重视通过以下方式促进新疆仲裁事业的发展:一是要加快仲裁机构体制机制的改革进程,从根本上解决仲裁机构“行政化”问题及其衍生问题;二是要积极通过制定地方立法、地方行政规范性文件及地方司法文件,或由仲裁机构制定专门性临时仲裁规则,或由仲裁机构联合其他机构制定临时仲裁指南,促进临时仲裁在新疆实质性落地;三是要探索建立“新疆仲裁联盟”和“新疆商事仲裁服务中心”作为新疆多元化、新型化仲裁平台的建设方向;四是要探索创立新疆仲裁协会和新疆仲裁员协会,以充分发挥行业协会的服务、规范和监督的职能。The overall development of arbitration in Xinjiang is inadequate,and it has not been able to play an effective role in supporting the sound operation of the Xinjiang Pilot Free Trade Zone.Combined with the actual situation in Xinjiang and the practice of arbitration development in other places in China,it is suggested that attention should be paid to promoting the development of arbitration in Xinjiang in the following ways:Firstly,we should speed up the process of reforming the institutional mechanism of arbitration institutions,so as to fundamentally solve the problem of‘administrativeisation’of arbitration institutions and its derivative problems;Secondly,we should actively promote the substantive implementation of ad hoc arbitration in Xinjiang through the formulation of local legislation,local administrative normative documents and local judicial documents,or the formulation of special ad hoc arbitration rules by arbitration institutions,or the formulation of ad hoc arbitration guidelines by arbitration institutions jointly with other institutions;Thirdly,we need to explore the establishment of the“Xinjiang Arbitration Alliance”and the“Xinjiang Commercial Arbitration Service Center”as the direction for building diversified and new arbitration platforms in Xinjiang;Fourthly,we should explore the creation of Xinjiang Arbitration Association and Arbitrators Association to give full play to the functions of service,regulation and supervision of the industry associations.
