数据知识产权保险发展与创新思考——以数据交易所合作视角

摘　　要：数据成为重要生产要素后,由于缺乏法律、技术方面的规制与保障,在其价值不断释放的同时,面临数据侵权、数据安全、交易不确定因素等具有复杂性和多样性的潜在风险,影响了数据要素的流转。充分发挥商业保险对数字经济“减震器”和社会“稳定器”的功能,以保险为手段加强数据知识产权有效保障是其中一条解决路径。本文从知识产权保险发展情况分析入手,经过对比各地数据知识产权保险的实施情况,从法理和操作层面分析利弊,不断创新保险服务数据要素流转的主要环节,助力以数据要素为底座的新质生产力的发展。针对全国数据交易所建设运营实际,提出以发挥数据交易所功能切入数据知识产权的保险业务的可能性,为数据知识产权商业保险的扩量提质与提升保障水平提供参考。As data emerges as a critical production factor,the lack of adequate legal and technical regulations and safeguards has led to potential risks with complexity and diversity,such as data infringement,data security issues,and uncertainty in transactions,while the value of data is constantly being unleashed.Giving full play to the functions of commercial insurance as a"shock absorber"for the digital economy and a"stabilizer"for society,and using insurance as a means to strengthen the effective protection of data intellectual property rights is one of the solution paths.Starting with an analysis of the development of intellectual property insurance,this paper compares the implementation of data intellectual property insurance across various regions,analyzes the pros and cons from both legal and operational perspectives,and continuously innovates insurance services in key aspects of data factor circulation,supporting the development of new quality productivity with data as its foundation.Based on the actual construction and operation of data exchanges nationwide,this paper proposes the possibility of initiating insurance business for data intellectual property rights through leveraging the functions of data exchanges,providing a reference for expanding the scale and improving the quality and safeguard level of commercial insurance for data intellectual property rights.
