“中—西时代”的阐释法哲学研究——从法律阐释的“三重话语结构”谈起

摘　　要：法律阐释蕴含着“语境—功能—对话”的“三重话语结构”和理解的“双重对话结构”。阐释法哲学聚焦的法律价值阐释,旨在通过一般性地把握法律行动的文化蕴含而阐释一个社会的法律价值观,可视为一种类文本的阐释活动。阐释法哲学与法律阐释共享着同样的“三重话语结构”和理解的“双重对话结构”,其“三重话语结构”分别对应着历史脉络阐释、建构性阐释和公共阐释等三种不同的阐释方法。与之相适应,阐释法哲学具有三种话语功能:面对历史的“阐释—反思”功能、面对实践的“阐释—范导”功能和面对西方理论的“对话—抗辩”功能。采用建构性阐释和公共阐释取径,可把党内法规定性为调整共产党人行为模式的一套“伦理法规范”,进而把它与国家法律的关系理解为法律多元主义背景下的复合法治格局。Legal interpretation embodies a“threefold discourse structure”of“context-function-dialogue”and a“dual dialogue structure”in understanding.The interpretive philosophy of law focuses on interpreting legal values and aims to understand a society’s legal value system by generally grasping the cultural connotations of legal actions,thereby constituting a form of quasi-textual interpretation.The interpretive philosophy of law shares the same“threefold discourse structure”and“dual dialogue structure”as legal interpretation.The“threefold discourse structure”encompasses historical-contextual interpretation,constructive interpretation,and public interpretation.Accordingly,interpretive philosophy of law serves three discourse functions:the“interpretativereflective”function in relation to history,the“interpretative-regulative”function in relation to practice,and the“dialogical-defensive”function in relation to Western theories.By employing constructive and public interpretive approaches,we can define“intra-Party regulations”as a set of“ethical legal norms”designed to regulate the behavior of Communist Party members.This allows us to understand their relationship with state law as a multilayered rule of law framework within a context of legal pluralism.
