摘 要:作为突发事件的首冲对象和应急响应的第一主体,基层自治组织面临社会风险建构性与隐蔽危害性、人为性与深度不确定性动静态相交织的复杂特征。在此情境下,基层自治组织受责任与风险双重驱动所采取的大量权宜策略,实际上已经超出了行政授权、行政委托的辐射边界,造成行政应急权移位、主体身份不明、责任空心化等“名”“实”分离现象。研究以厘清基层自治组织行政应急权扩张的法理依据和生成逻辑为前提,指出限定型行政辅助方式作为归置容器。并在“情境-策略”框架下探明其实践向度指向策略性推动治理跟进与不同阶段社区风险演进情境的适配性。归纳而言,基层自治组织作为私主体参与应急治理需要在情境转换阶段以组织内外相联系达成风险共识、以有权主体与责任主体相聚合实现跃迁阶段的差异沟通、协调应急权与弹性适应从而链接整合社区复合界面,以更好地推动应急协同治理的合理合法与迅速有效。As the primary object of influence of emergencies and the primary subject of emergency response,grassroots mass self-governing organizations are faced with the constructive and hidden hazards,artificiality and depth of uncertainty of social risks.These features are complex and give rise to a process in which dynamics and statics are intertwined.Under such circumstances,a large number of expedient strategies adopted by grassroots mass self-governing organizations,driven by both responsibility and risk,have actually exceeded the radiating boundaries of administrative authorization and administrative entrustment,resulting in the displacement of administrative contingency power,unclear identity of the main body,hollowing out of responsibility,and other phenomena that do not conform to the name and practice.This paper to clarify the administrative emergency power to grassroots mass self-governing organizations to expand the legal basis and generation of logic as the premise,pointed out that the limited administrative auxiliary way as a restitution container.From the perspective of“situation-strategy”analysis,the paper also explores the appropriateness of its practical orientation to strategically promote the follow-up of governance and the evolution of community risks at different stages.In conclusion,the participation of grassroots autonomous organizations in emergency governance as private subjects needs to rely on the internal and external links to reach a consensus on risks during the transition phase of the situation,to realize the communication of differences during the leap phase through the linkage between the entitled subjects and the responsible subjects,and to coordinate the emergency response rights with the resilient adaptations,thus linking and integrating the community composite interfaces.It is only by doing so that we can better promote rational,legitimate,rapid and effective collaborative emergency governance.
