摘　　要：《民法典》《民事强制执行法(草案)》等规范规定了部分财产的执行顺序,但用于夫妻共同财产执行时仍存在模糊或冲突之处,亟需厘清。夫妻共同财产的执行顺序,是同一执行程序内部处置不同夫妻财产的顺序,不同于多个执行程序顺次执行、清偿顺序或先诉抗辩权。确定夫妻共同财产的执行顺序,应结合实体法与程序法规定,考量债务性质、债务人配偶等主体的利益保护、善意文明执行理念以及执行效率等因素。在夫妻共同财产外部,夫妻一方对外负债的,应先于夫妻共同财产执行债务人的个人财产,后执行家庭共同财产,最后执行共同继承财产、合伙企业财产等财产;在夫妻共同财产内部,可依据财产登记情况、方便处置程度和权属争议大小等,设置不同形态夫妻共同财产的执行顺序。Norms such as the Civil Code and the Civil Compulsory Execution Law(Draft)have stipulated the ownership of certain assets the order of execution,but there are still ambiguities or conflicts when it comes to the execution of joint property between spouses.It is urgent need clarification.The order of execution of joint property between spouses is different within the same execution procedure.The order of marital property is different from the sequential execution of multiple execution procedures,the order of settlement,or the priority of litigation right of defense.The order of execution of joint property between spouses should be determined in conjunction with substantive laws and procedural regulations considering the nature of the debt,the protection of the interests of the debtor's spouse and other parties,and good faith and civilized execution factors such as ideology and execution efficiency.Outside the joint property of husband and wife,one party is responsible to the outside world for debts,the debtor's personal property should be executed before the joint property of husband and wife,and then the joint property of the family should be executed same property,ultimately executing joint inheritance of property,partnership property,and other assets.In the community of husband and wife within the same property,it can be determined based on the property registration status,ease of disposal,and the size of ownership disputes wait,set the order of execution for different forms of joint property between spouses.
