摘 要:本研究探讨了国际知识产权法在种子品种保护中的应用,重点分析了UPOV公约和TRIPS协定的具体条款及其在不同国家的实施情况。通过对孟山都与农民的专利诉讼、Syngenta在印度的品种保护争议以及中国企业在非洲的种子品种保护等案例的分析,揭示了知识产权保护在促进农业创新和保护育种者权益方面的重要作用。同时,研究也指出了当前法律框架中存在的挑战。针对这些问题,本研究提出了完善法律框架、提高法律执行效果、增强国际合作与交流以及考虑新兴技术影响的政策建议,以实现知识产权保护与农业可持续发展的平衡。通过这些措施,旨在促进全球农业科技的发展,实现粮食安全和环境保护的目标。This study explores the application of international intellectual property law in the protection of seed varieties,focusing on specific provisions of the UPOV Convention and the TRIPS Agreement and their implementation in different countries.By analyzing cases such as Monsanto's patent litigation with farmers,Syngenta's variety protection disputes in India,and Chinese companies'seed variety protection in Africa,the research reveals the significant role of intellectual property protection in promoting agricultural innovation and safeguarding breeders'rights.The study also identifies challenges within the current legal framework.To address these issues,it proposes policy recommendations such as improving the legal framework,enhancing the effectiveness of law enforcement,strengthening international cooperation and communication,and considering the impact of emerging technologies.These measures aim to balance intellectual property protection with sustainable agricultural development.By promoting global agricultural technology development,the study seeks to achieve food security and environmental protection goals.
