摘　　要：本文将问题聚焦于平台经济中平台企业滥用市场支配地位的行为,以此剖析平台滥用市场支配地位的成因、危害。文章首先介绍了平台经济的重要性和滥用市场支配地位行为的频发情况,接着详细分析了滥用行为的类型,包括强制商家“二选一”、大数据杀熟、算法共谋等,并阐述了这些行为对市场竞争、消费者利益以及创新和技术进步的严重负面影响。此外,文章还通过具体案例,如阿里巴巴因强制商家“二选一”被罚款,进一步揭示了滥用行为的恶劣行径和监管部门的严厉打击态度。最后,文章提出了针对滥用市场支配地位行为的法律规制建议,包括深化法律法规体系建设、强化监管与执法力度、完善司法保障与救济机制。这些建议旨在为构建一个更加公平、透明、高效的竞争环境提供有益的思路。This article focuses on the behavior of platform enterprises abusing their market dominant position within the platform economy,thereby analyzing the causes and hazards of such abuse.It begins by introducing the significance of the platform economy and the frequent occurrence of abuse of market dominant position.Subsequently,it meticulously analyzes various types of abusive behaviors,including forcing merchants to choose between platforms("either-or"clauses),leveraging big data for price discrimination,algorithmic collusion,and others.The article also elaborates on the severe negative impacts of these behaviors on market competition,consumer interests,as well as innovation and technological progress.Furthermore,through specific cases such as Alibaba being fined for enforcing"either-or"clauses on merchants,the article further reveals the egregious conduct of such abuse and the regulatory authorities'stern stance against it.Finally,the article proposes legal regulatory suggestions tailored to address the abuse of market dominant position,encompassing deepening the development of legal and regulatory frameworks,strengthening supervision and enforcement efforts,improving judicial protection and remedy mechanisms,and other aspects.These suggestions aim to provide valuable insights for constructing a fairer,more transparent,and efficient competitive environment.
