生成式人工智能监管视角下数据安全治理研究

摘　　要：随着技术的发展,数据安全和隐私保护已成为我国乃至全球关注的重点。生成式人工智能作为一种新兴技术,在创造内容的同时也可能引发数据安全和隐私问题。若根据数据生命周期的不同阶段对风险进行分类,可将数据风险划分为输入、处理、存储、运算和输出等阶段,每个阶段均面临不同的风险类型。虽然近年来我国在生成式人工智能领域的相关立法与规定已逐步完善,然而,在生成式人工智能技术迅速迭代及广泛应用的背景下,我国现行的监管体系仍需应对诸多挑战与难题。未来我国应持续秉持包容审慎的监管模式和敏捷型安全治理原则,针对不同主体实施差异化监管策略,构建全方位全链条监管体系,保障数据安全风险的有效治理。With the development of technology,data security and privacy protection have become key concerns in China and even globally.As an emerging technology,generative artificial intelligence may trigger data security and privacy issues while creating content.If risks are classified according to different stages of the data lifecycle,data risks can be divided into stages such as input,processing,storage,operation,and output,and each stage faces different types of risks.Although China's relevant legislation and regulations in the field of generative artificial intelligence have been gradually improved in recent years,against the backdrop of the rapid iteration and widespread application of generative artificial intelligence technology,China's current regulatory system still needs to address many challenges and problems.In the future,China should continue to adhere to an inclusive and prudent regulatory model and the principles of agile security governance,implement differentiated regulatory strategies for different entities,build a comprehensive and full-chain regulatory system,and ensure the effective governance of data security risks.
