摘 要:罪错未成年人分级处遇制度所蕴藏的犯罪控制价值未得到充分挖掘。以促进个体价值观与规范价值契合为本质的协商性法律社会化,能够为罪错未成年人分级处遇制度的优化提供方向性指引。既存罪错未成年人分级处遇制度在程序和实体上均难以达成规范价值内化的旨趣,应当根据协商性法律社会化的要求进行程序与实体两个维度的整饬。在程序上,刑事司法与分级处遇在转处后的贯通上仍应围绕行政主体决定模式进行建构,并强化罪错未成年人进入至转出专门学校过程中的程序性权利保障。在实体上,罪错未成年人分级处遇制度必须认真对待保护处分的功能异化现象。宜通过措施专业化与监督机制化增强限制自由型保护处分的效能,并在实质性制裁额度下构建动态处理惩罚与保护处分并合适用的规则。The value of crime control contained in the treatment classification system of juvenile delinquents has not been fully explored.The consensual legal socialization with the essence of promoting the compatibility of individual values and normative values can provide directional guidance for the optimization of the treatment classification system of juvenile delinquents.It is difficult to achieve the goal of internalizing the normative values in both procedure and substance of the present treatment classification system of juvenile delinquents.The order of procedure and substance should be carried out according to the requirement of consensual legal socialization.In terms of procedure,the connection between criminal justice and treatment classification system should still be constructed around the decision mode of administrative subject,and the protection of procedural rights of juvenile delinquents in the process of entering and transferring from specialized schools should be strengthened.In the substance,the treatment classification system of juvenile delinquents must take seriously the function alienation phenomenon of protective treatment.It is advisable to enhance the effectiveness of the restrictive treatment measures through the specialization of measures and the supervision mechanism,and to construct the dynamic rules for the combination of punishment and protective treatment under the substantive sanction limit.
