地方党内法规制定问题的历史阐释及规范调适

摘　　要：地方党内法规制定是推动党内法规制度建设高质量发展的关键议题。实践中地方党内法规的制定存在配套无序化、内容同质化和形式杂乱化三个方面的问题。从历史视角来看,这些问题的产生、发展与党内法规在不同时期作为党的政策或纪律的制度化探索、制度高级形态的法、法体系中独立规范的定位有密切关系。在该过程中,地方党内法规的定位经历了从一体化考量到差异化确立再到体系化面向的三个阶段,其对相关制定规范要求有所不同。对此,应立足于2019年《中国共产党党内法规制定条例》,整体性认识其中地方党内法规的相关规定,通过瞄准定位立规、强调审慎立规和坚持及时立规,进而调适地方党内法规制定问题。The construction of local intraparty rules and regulations is an inherent requirement for promoting rule-based governance over the party.However,there are many problems with the formulation of local intraparty rules and regulations in practice,which are mainly manifested in three aspects:disordered supports,homogenization of content and messy forms.From a historical perspective,the development of formulating local intraparty rules and regulations against the central intraparty rules and regulations has gone through three stages,from integrated consideration to differentiated establishment and then to systematic orientation.And these problems are derived from the tension brought by the normative evolution of the process,which means intraparty rules and regulations have changed from the early institutionalised exploration of the party’s policies or disciplines to the development of the law of the system in its advanced form to the deepening of systematic construction,on the practice of local intraparty rules and regulations.In this regard,only based on the Regulation of the Communist Party of China on Development of Intraparty Regulations revised in 2019,understanding the normative meaning of the provisions about local intraparty rules and regulations comprehensively,can we gradually solve the problems of formulating local party laws and regulations by aiming at the positioning of the regulations,emphasising on the prudence of the regulations,and insisting on the timely formulation of the regulations.
