摘　　要：随着“保护知识产权,就是保护创新”的理念提出,我国对知识产权的重视程度不断提高,公众对知识产权保护意识逐渐增强,我国专利法也在一次次修订中不断完善。只有更好地运用专利权无效宣告制度,才能更好地保护知识产权、营造出良好的创新环境。首先从专利权无效宣告制度进行分析,选取了美国、德国、法国、日本、韩国5个知识产权领域发展较为成熟的国家的立法状况进行研究。其次从我国专利权无效宣告制度的起源与发展特征出发,并结合典型案例对专利权无效宣告制度的运用状况及存在的问题进行了分析。最后结合我国实际情况,给出了优化审查流程、加强市场监管、畅通和专利侵权纠纷的衔接机制的建议,可为后续立法完善、制度完善、机制完善提供参考。With the concept of“Protecting intellectual property is protecting innovation”proposed,emphasis and awareness on intellectual property protection is ever-increasing in the public.The patent law is also constantly being improved through revisions in China.By utilizing the institution of patent invalidation can we better protect intellectual property and create a favorable environment for innovation.In this paper,five countries with mature development on patent invalidation institution,such as the United States,Germany,France,Japan,and South Korea is selected as legislation research subject firstly.Secondly,on the basis of development features of patent invalidation institution,this paper analyzed the application status and existing problems of the patent invalidation institution in China from the view of typical cases.Finally,combining the actual situation,three suggestions were put forward:optimizing the examination process,strengthening market supervision,and facilitating the connection mechanism between patent infringement disputes and patent invalidation,and laying a foundation for subsequent legislative improvement,institutional improvement,and mechanism improvement.
