摘 要:数字经济时代,数据成为平台企业的核心要素。传统隐私权无法满足消费者对个人数据的控制需求,并在隐私权的基础上衍生数据隐私概念。当下,通过传统反垄断法对数据隐私问题进行调整存在一定难题。首先,数据隐私未成为反垄断法的立法保护范围;其次,数据隐私保护与市场利益及效率间存在协调平衡问题;最后,隐私保护法与反垄断法二者之间规则存在竞合问题。为纾解此难题,应健全数据隐私的反垄断法框架,提高数据隐私保护的适配性;推进反垄断法的价值重塑,兼顾隐私保护与市场竞争;运用精细分析方法,区分侵害数据隐私的具体行为。In the era of digital economy,data has become the core element of platform enterprises.Traditional privacy rights cannot meet consumers'demand for personal data control,and the concept of data privacy is derived on the basis of privacy rights.At present,it is difficult to adjust data privacy issues through traditional antitrust laws.First of all,data privacy has not become the scope of legislative protection of anti-monopoly law;Secondly,there is a problem of coordination and balance between data privacy protection and market interests and efficiency.Finally,there is a problem of competition and cooperation between privacy protection law and anti-monopoly law.In order to alleviate this problem,we should improve the anti-monopoly legal framework of data privacy and improve the adaptability of data privacy protection.Promote the value reconstruction of anti-monopoly law,considering privacy protection and market competition;The detailed analysis method is used to distinguish the specific behaviors that infringe data privacy.
