摘 要:城市社区物业管理中,共有产权治理的过程面临着产权与治权的内在张力,这需要对其中的治理机制进行有意的设计。物业管理中共有产权部分的有效治理倚赖物业公司构造一个适宜性力量的框架,并在纵向和横向层面通过整合各类规制性要素、规范性要素和认知性要素来形成差异化的治理类型。在厘清治理力量运作结构的基础上,我们发现这其中存在三种逻辑:一是以共有产权社会化管理为价值旨趣的社会逻辑;二是以物业管理力量嵌入自主性为实施取向的组织逻辑;三是以共有空间连续性服务为行动追求的行动逻辑。基于社区物业管理中共有产权治理力量与治理逻辑的相互作用,物业公司以一系列合作行动来促进共有产权所涉公共利益和共同价值的共创共享。The process of co-ownership governance in urban community property management is confronted with the inherent tension between property rights and governance rights,which requires intentional design of the governance mechanism.The effective governance of the co-ownership part in property management relies on the property management company to construct a suitable power framework and form differentiated governance types by integrating various regulatory,normative and cognitive elements at both vertical and horizontal levels.Based on clarifying the operational structure of governance power,we find that there are three logics:the first is the social logic with the value orientation of socialized management of co-ownership;the second is the organizational logic with the implementation orientation of embedding property management power into autonomy;the third is the action logic with the action pursuit of continuous service in common spaces.Based on the interaction between the governance forces and governance logics of common property rights in community property management,property management companies promote the co-creation and sharing of public interests and common values involved in common property rights through a series of cooperative actions.
