多源流理论视域下《国家通用语言文字法》的修订研究

摘　　要：国家之魂,文以化之,文以铸之。《国家通用语言文字法》既是促进语言文字规范化、标准化、信息化建设的必然要求,又是深入推进我国语言文字法治工作的重要保障,还是建设中华民族共有精神家园、铸牢中华民族共同体意识的内在需要。运用多源流理论分析《国家通用语言文字法》修订的政策过程具有适切性,现有法律的调整范围和规范对象受限、软法属性制约国家通用语言文字的主体地位、未明确执法主体和相关部门职责构成问题源流;全国人大代表及政协委员的语言文字提案、专家学者的资政建言与学术研究、国家与地方有关部门的前期政策探索构成政策源流;党中央高度重视国家语言文字的改革与发展、国家领导人多次强调国家通用语言文字的普及和推广、社会公众对我国语言文字事业发展的迫切期待构成政治源流。三流交汇形成耦合机制,继而开启《国家通用语言文字法》修订的政策之窗,未来应聚焦问题源流,明晰修法的目的和任务;遵循政策源流,筛选最优化的修法方案;吸纳政治源流,赋能修法向公共性回归。The soul of a nation is forged by culture.The law of the national common language and script is not only an inevita⁃ble requirement to promote the construction of language and script normalization,standardization and informatization,but also an im⁃portant guarantee to further promote the rule of law on language and script in China,and an intrinsic necessity to build the common spiritual home of the Chinese nation and to consolidate the sense of community of the Chinese nation.It is appropriate to analyze the policy process of the revision of the law of the national common language and script by applying the multiple streams theory.The restriction of the scope of adjustment and the object of regulation of the existing law,the attribute of the soft law that restricts the status of the law of the national common language and script,and the lack of clarity of the main body of the law enforcement and the responsibilities of the relevant departments constitute the source of the problem.The language and script proposals of the National People’s Congress deputies and members of the Chinese People’s Political Consultative Conference,the political advice and academic research of experts and scholars,and the preliminary policy exploration of national and local departments constitute the source of the policy.The Party Central Committee attaches great importance to the reform and development of the national lan⁃guage and script system,the national leaders have repeatedly emphasized the popularization and promotion of the law of the nation⁃al common language and script,and the public is eagerly looking forward to the development of the cause of language and scrip sys⁃tem in China,which constitute the political stream.The convergence of the three streams forms a coupling mechanism,which then opens the policy window for the revision of the law of the national common language and script.In the future,we should focus on the source of the problem to clarify the purpose and task of the law revision.We follow the source
