海河流域水利工程运行管理现状研究

摘　　要：水利工程作为国民经济和社会发展的关键基础设施,在抵御水旱灾害、确保人民生命财产安全、推动国民经济发展、实现水资源可持续利用以及保护生态环境等方面具有不可替代的作用。近年来,我国在水利工程运行管理和保护领域已经构建起了一个全方位的法律体系,以《中华人民共和国水法》《中华人民共和国防洪法》《中华人民共和国河道管理条例》《中华人民共和国水库大坝安全管理条例》及《中华人民共和国防汛条例》为核心,明确了水利工程保护、划定保护区防止污染、禁止侵占毁坏工程、防洪规划、河道整治、水库大坝安全管理及防汛指挥等关键环节的法律要求,为水利工程的安全、高效运行及国家水安全提供了坚实的法律保障。海河流域各省(自治区、直辖市)基本围绕水利工程运行管理与保护构建了完善的地方性法律法规体系。以海河流域水利工程运行管理制度为研究对象,通过对现有法律法规的梳理分析,结合海委直管工程在运行管理和保护方面遇到的问题,提出针对性的措施建议和立法完善路径,旨在为海河流域法治能力建设提供参考,推动水利高质量发展,保障我国水安全。As the key infrastructure of national economic and social development,water conservancy projects play an irreplaceable role in resisting floods and droughts,ensuring the safety of people's lives and property,promoting national economic development,realizing the sustainable utilization of water resources,and protecting the ecological environment.In recent years,China has established a comprehensive legal framework for the operation,management,and protection of water conservancy projects.This framework is centered on core legislation,including the Water Law of the People's Republic of China,the Flood Control Law of the People's Republic of China,the Regulations on River Dam Safety Management,and the Regulations on Flood Control.These laws clarify legal requirements for water conservancy project protection,designated reserves to prevent pollution,prohibitions on engineering damage,flood control planning,river regulation,reservoir dam safety management,and flood control command systems.Collectively,they provide a robust legal foundation for ensuring the safe and efficient operation of water conservancy projects as well as national water security.Provinces and cities in the Haihe River Basin have generally established sound local regulatory systems focusing on the operation,management,and protection of water conservancy projects.Taking the operation and management system of water conservancy projects in the Haihe River Basin as the research object,the targeted measures and legislative recommendation were proposed through analyzing existing laws and regulations and combing with the problems encountered in operation management and protection of the Haihe River Basin Committee's directengineering projects.These aim to support legal capacity-building in the Haihe River Basin,promote high-quality development of water conservancy,and ensure national water security.
