摘  要:海河流域在我国具有重要地位,推进流域水法治建设,为流域水利高质量发展提供坚实法治保障具有重要意义。党的十八大以来,依法治国理念与国家“江河战略”的推进为海河流域河湖管理法律制度的完善提供了契机。阐述了依法治国与“江河战略”实施背景下流域立法的必要性,对海河流域河湖管理现状及问题进行分析,其中涵盖河湖长制落实、水域岸线管理、采砂管理等方面的具体举措与成效。针对海河流域河湖管理法律制度存在的问题提出相应立法建议,推动河湖长制纳入海河保护法、加强岸线管控规划约束、完善采砂规划体系。通过完善海河流域河湖管理法律体系,推动流域水利高质量发展。The Haihe River Basin holds strategic significance in China's socioeconomic and ecological landscape,as it serves as a critical arena for advancing legally institutionalized water governance to secure high-quality water conservancy development.Since the 18th National Congress of the Communist Party of China,the nationwide promotion of rule of law principles and the River Chief System has provided unprecedented opportunities to refine the basin's river-lake governance framework.The necessity of basin-specific legislation under the dual imperatives of rule of law modernization and the River Chief System was elaborated,the current governance status were systematically evaluated—including the implementation efficacy of measures such as the River Chief System,shoreline and water resource management,and sand mining regulation existing in the legal system of river and lake mana gement in Haihe River Basin.To address these challenges,the legislative reforms were proposed that institutionalize the River Chief System within the Haihe River Protection Law,strengthen regulatory frameworks for shoreline spatial control through binding planning instruments,and optimize sand mining management by integrating ecological thresholds into regulatory standards.These measures aim to advance high-quality water conservancy development in the basin through a rule-of-law-based governance paradigm.
