摘　　要：按照汉代司法程序,赦令颁布以后,需由刑徒向主管机构提出申请。主管机构根据刑徒所在机构上报的劳役完成情况制作定簿,核验刑徒劳役执行情况。县廷对主管机构及刑徒所在机构提供的文书进行互查,确认属实后上报郡府。郡府或位于本郡的同阶机构下达最后的减刑判定书。被赦免前为鬼薪白粲至死刑者获得减刑,复作结束后,申请过关传返回原籍。被赦免前为司寇者,免为庶人,直接申请过关传返回原籍。复作期间可以诏书入钱赎免为庶人,亦可选择赎免部分日期。According to the judicial procedures of the Han Dynasty,after the issuance of the pardon order,the prisoners had to submit applications to make cases to the competent authorities.Based on the report provided by the concerned prisons,the authorities would verify that the applicants had fulfilled their required labor services.After these,the documents need to go through the re-examinations of the county level governments.The prefectural governments therefore might issue the final commutation decision.Those sentenced to death penalty might be sent home after a short period of labor service.Those sentenced to serve on the frontier as border guards might be released directly for home.
