我国 “取水贷 ”融资模式的困境与对策研究

摘　　要：为贯彻落实党的二十届三中全会精神,水利部召开党组会议强调要推进用水权交易市场建设、强化水利投融资体制改革,推动水利高质量发展。“取水贷”融资是实现这一目标的重要手段。在水权交易市场中,“取水贷”融资活动是盘活水资源资产、发展绿色金融的重要路径之一。以取水权作为标的进行担保能够帮助企业提升其水资源资产价值,解决融资困难。文章通过梳理我国“取水贷”融资模式的发展现状,概括出目前“取水贷”运行过程中还存在着取水权的法律属性界定模糊、融资担保方式不统一、融资业务监管机制不健全以及激励措施不足等问题。基于此,提出未来应当完善立法明确取水权的法律属性、规范融资担保方式、完善监管体系与激励机制,切实有效推进水利投融资改革。In order to implement the spirit of the Third Plenary Session of the 20th Central Committee of the Communist Party of China,the Ministry of Water Resources held a party group meeting to emphasize the need to promote the building of the water rights trading market,strengthen the reform of the water conservancy investment and financing system,and promote high-quality development of water conservancy.Water-extracting loan financing is an important means to achieve this goal.In the water rights trading market,“water-extracting loan”financing activities are one of the important paths to activate water resources assets and develop green finance.Using water-extracting rights as collateral can help companies enhance the value of their water resources assets and solve financing difficulties.This article summarizes the current development status of China s“water-extracting loan”financing model,and concludes that there are still problems in the operation of“water-extracting loan”,such as vague legal definition of water-extracting rights,inconsistent financing guarantee methods,inadequate financing business supervision mechanisms,and insufficient incentive measures.Based on this,it is proposed that in the future,legislation should be improved to clarify the legal attributes of water rights,financing guarantee methods should be standardized,regulatory systems and incentive mechanisms should be improved to effectively promotewater conservancy investment and financing reforms.
