数字“一带一路”的国际经贸规则法治化建设研究

摘　　要：数字贸易已成为推动“一带一路”高质量发展的重要引擎,随着我国和沿线国家着重构建数字基础设施和网络平台推广数字贸易,数字“一带一路”体系逐渐形成。然而,现有贸易规则在电子签名和认证、网络知识产权、跨境数据流动等新的问题上存在规则冲突与竞争,迫切需要一套更加全面的经贸规则来应对。研究认为,构建区域层面与多边层面的数字贸易规则,应以数字“一带一路”的建设与发展为出发点,依托“一带一路”倡议,采取融合性、利益非对称性、争议解决非制度化等合作机制,规避自由化程度过高、歧视性或规则设置模式,积极实施数字国际贸易等诸边协议,并推广e-WTP合作机制,以形成全球数字国际贸易平台。Digital trade has become an important engine to promote the high-quality development of“The Belt and Road”.China and the countries along“The Belt and Road”have focused on building digital infrastructure and network platforms,promoting digital trade,and gradually establishing a digital“The Belt and Road”system.There are conflicts and competition in existing trade rules regarding new issues,such as electronic signatures and authentication,online intellectual property,and cross-border data flow,and thus there is an urgent need for a more comprehensive set of economic and trade rules to address them.Therefore,we should build digital trade rules at the regional and multilateral levels,take the construction and development of the digital“The Belt and Road”as the starting point,rely on the“The Belt and Road”strategy,adopt such cooperation mechanisms as integration,asymmetric interests,and non institutionalized dispute resolution,avoid excessive liberalization,discriminatory or rule setting models,actively implement multilateral agreements,such as digital international trade,and promote e-WTP cooperation mechanisms,in order to form a global digital international trade platform.
