《体育法》“竞技体育”章修订的若干重点问题探析

摘　　要：竞技体育在我国体育事业发展中具有重要地位,《体育法》也专章规定了竞技体育的内容。在《体育法》的全面修订中,竞技体育部分有诸多亮点,体现了立法的民主性与科学性,立法进步显而易见。我国计划体制下的竞技体育举国体制和市场经济下的职业体育,运动员权利的保障和竞技体育后备人才的培养,这些问题交织并构成“竞技体育”章内容的基本框架,也成为文章研究的主要问题与制度评价的对象。在《体育法》修订过程中形成了多个法律条文建议稿版本,国家体育行政部门和国家社会科学基金重大项目课题组的修法文本无疑是权威的和有代表性的。文章以这两个修法文本作为与新旧《体育法》比较研究的基础,以竞技体育体制改革、职业体育发展、运动员权利保障、后备人才培养为研究内容,以多个法律文本的比较为研究视角和方法,提炼“竞技体育”一章修法的主要问题,评析相关的政策嬗变和法律的制度构建,探讨新修订的《体育法》的立法进步。Competitive sports hold a significant position in the development of sports in China,and the new Sports Law dedicates a chapter to competitive sports.In the comprehensive revision of the“Sports Law”,there are many highlights in the competitive sports section,reflecting the democracy and science of legislation,and the progress in legislation is evident.The wholenation system of competitive sports under the planned system and professional sports under the market economy,the protection of athletes’rights,and the cultivation of reserve talents for competitive sports are intertwined and form the basic framework of the“competitive sports”chapter,and they are also the main issues and the objects of institutional evaluation in this paper.During the revision process,multiple versions of legal text suggestions were proposed,and the two revision texts proposed by the national sports administration department and the major project teams of the National Social Science Fund are undoubtedly authoritative and representative.Taking these two revision texts as the basis for a comparative study of the old and the new version of Sports Law,this paper aims to define the main issues related to the revision of“competitive sports”,analyze the transformation of related policies and the construction of legal systems,and evaluate the legislative progress in the new Sports Law through examining the reform of the competitive sports system,the development of professional sports,the protection of athletes’rights,and the cultivation of reserve talents.
