摘　　要：我国铁路工程建设行业早期管理形式粗放,部分铁路工程非法转包、违法分包问题突出,严重干扰了正常的市场秩序,不但导致铁路工程存在质量隐患,还容易产生农民工工资拖欠等问题,影响社会稳定。因此,有必要厘清转包和违法分包的法律界限,找到规制违法分包的办法和路径,促进铁路工程建设行业参建单位和工作人员形成规则意识,防范相关法律风险。In the early stages,the management form of China’s railway engineering construction industry was extensive,and illegal subcontracting and unlawful subcontracting of some railway projects were prominent issues,seriously disrupting the normal market order.This not only posed quality hidden dangers in railway projects but also easily led to problems such as arrears in migrant workers’wages,affecting social stability.Therefore,it is necessa-ry to clarify the legal boundaries between subcontracting and unlawful subcontracting,identify methods and paths to regulate unlawful subcontracting,promote rule awareness among participating units and staff in the railway engi-neering construction industry,and prevent relevant legal risks.
