摘　　要：人格权编在《民法典》中独立成编,彰显了法律对人格权主体权利的保护,然而其中第997条关于人格权行为禁令的规定,却在实施过程中屡陷困境,究其原因主要是该规定较笼统,司法实践中大多借鉴人身安全保护令或者保全制度的相关规定,造成了“同案不同判”的现象。人格权行为禁令因其适用条件及立法目的的特殊性,需协调公平价值与效率价值,为实现该条文的立法目的,不应执着于讨论适用诉讼或非讼程序,而是充分发挥不同程序的最大效用。对此,通过对人格权行为禁令条款诉讼与非讼合理性进行分析,尽可能构建一套诉讼与非讼相衔接、可灵活切换的程序,旨在实现民事实体法与民事程序法更加融洽的衔接。The independent codification of the Personality Rights section in the Civil Code underscores the law’s protection of the rights of personality right subjects.However,Article 997,concerning personality right conduct injunctions,has repeatedly encountered difficulties in implementation.The main reason for this is that the provision is relatively general,and judicial practice mostly draws on relevant provisions of personal safety protection orders or preservation systems,resulting in the phenomenon of different verdicts for similar cases.Due to the spe-cial nature of its application conditions and legislative purposes,personality right conduct injunctions require a bal-ance between fairness and efficiency values.To achieve the legislative intent of this provision,it is not advisable to dwell on whether to apply litigious or non-litigious procedures but instead to fully leverage the maximum effective-ness of different procedures.In response,by analyzing the rationality of litigious and non-litigious procedures for personality right conduct injunction clauses,this paper aims to construct a flexible and interconnected procedure system that can switch between litigious and non-litigious procedures as much as possible,aiming to achieve a more harmonious connection between civil substantive law and civil procedural law.
