摘　　要：当前轻罪立法扩大化的背景下催生出大量轻罪犯,而成年轻罪犯如何复归社会成了一个亟待解决的问题。其中最核心的问题是如何解决因犯罪产生的犯罪记录所带来的一系列附随后果。为此,有必要构建轻罪视域下的成年人犯罪记录封存制度。在此基础上需要明确轻罪与重罪的划分界限,确定犯罪记录的封存范围,分析刑罚附随后果对被害人、社区、用人单位等主体的影响,明晰我国现行法律规范与司法实践的冲突,以顺应法治现代化的发展前景。在罪刑相适应与罪责自负原则的引导下,参照未成年人犯罪记录封存制度,使公民个人信息保护与公众知情权达到平衡,从而实现轻罪视域下成年人犯罪记录封存制度的立法塑造。Against the backdrop of the expansion of misdemeanor legislation,a large number of misdemeanor offenders have emerged,and how to rehabilitate adult misdemeanor offenders back into society has become an ur-gent issue to be addressed.The core issue here lies in resolving the series of collateral consequences resulting from criminal records due to offending.To this end,it is necessary to establish a sealing system for adult criminal re-cords from the perspective of misdemeanors.On this basis,it is required to clarify the dividing line between misde-meanors and felonies,determine the scope of sealing criminal records,analyze the impact of collateral conse-quences of punishment on victims,communities,employers,and other entities,and make clear the conflicts be-tween China’s current legal norms and judicial practice,in order to comply with the development prospects of modernization of the rule of law.Guided by the principles of suitability of punishment to crime and individual re-sponsibility for crime,and with reference to the sealing system of juvenile criminal records,a balance should be a-chieved between the protection of citizens’personal information and the public’s right to know,thereby realizing the legislative shaping of the sealing system for adult criminal records from the perspective of misdemeanors.
