摘　　要：随着改革开放的深入,民营经济逐渐成为我国经济的重要组成部分,并在推动经济增长、创新驱动和社会就业方面发挥着不可或缺的作用。我国《宪法》第11条作为保障非公有制经济的重要条款,自1982年首次提出个体经济的合法地位以来,经历了1988年对私营经济的确认,以及1999年和2004年对非公有制经济法律地位的提升。《宪法》第11条的逐步演变体现了我国对民营经济平等权与经营自由的法律保护。然而,随着全球化和经济形势的变化,民营经济的发展面临新的挑战。因此,探讨《宪法》第11条的历史演变及其在保障民营经济平等权和经营自由方面的作用,具有重要的理论与实践意义。通过分析《宪法》第11条的历史变迁,旨在阐述平等权与经营自由在民营经济发展中的相互作用,提出对未来宪法修改的展望,以进一步推动民营经济的健康发展。With the deepening of reform and opening-up,the private economy has gradually become a vital component of China’s economic structure,playing an indispensable role in driving economic growth,fostering in-novation,and promoting social employment.Article 11 of China’s Constitution,as a crucial provision safeguard-ing the non-public sector of the economy,has undergone significant evolution since its inception in 1982,which first affirmed the legal status of individual businesses.This was followed by the recognition of the private economy in 1988,and the elevation of the legal status of the non-public sector in 1999 and 2004.The progressive evolution of Article 11 reflects the legal protection of equal rights and business freedom for the private economy in China.However,with the changes in globalization and economic conditions,the development of the private economy faces new challenges.Therefore,exploring the historical evolution of Article 11 and its role in safeguarding the equal rights and business freedom of the private economy holds significant theoretical and practical importance.By analy-zing the historical changes of Article 11,this paper aims to elucidate the interplay between equal rights and busi-ness freedom in the development of the private economy and propose prospects for future constitutional amendments to further promote the healthy development of the private economy.
