中国(新疆)自贸试验区法制体系建构的价值意蕴与实践路径

摘　　要：良法善治是推进中国式现代化的基本路径,法制体系是良法善治的第一面向。健全法制体系既是新疆自贸试验区建设的重点目标任务,更是推进其高质量建设的重要保障措施。以立法机制建构系统整体协同高效的新疆自贸试验区法制体系,对于推动新疆自贸试验区打造一流营商环境、夯实高质量发展制度基础、实现发展与安全动态平衡、推动中国特色社会主义法学体系创新发展,具有莫大助益。新疆自贸试验区法制配置虽有推进,但制度供给总体迟缓短缺,难以有效因应新疆自贸试验区改革任务的目标诉求。十年来我国自贸试验区法制建设的实践经验,形成了以“‘调法调规’+‘条例’+配套性规范文件”为发展主线的中国特色社会主义自贸试验区法制体系,这些都成为新疆自贸试验区法制体系建构的有益借鉴。新疆自贸试验区应循此实践逻辑,全方位构筑以“调法调规”为重点,以“中国(新疆)自由贸易试验区条例”为中心,以“配套性规范文件”为重要组成部分的多元化法制保障体系。此外,新疆自贸试验区还应积极争取国家层面“地方立法变通授权”,从而释放符合新疆自贸试验区特殊性的发展潜力,主动对接国际高标准经贸规则,为我国建设更高水平对外开放探索新路径。Sound laws and good governance constitute a fundamental pathway for advancing Chinese modernization,with the legal system serving as the primary dimension of such governance.Improving the legal system is not only a key objective in developing the Xinjiang Pilot Free Trade Zone(FTZ) but also a critical safeguard for its high-quality advancement.Establishing a systematic,integrated,coordinated,and efficient legal framework through robust legislative mechanisms will significantly contribute to creating a first-class business environment,consolidating institutional foundations for high-quality development,achieving dynamic equilibrium between development and security,and fostering innovation in the socialist legal system with Chinese characteristics.Despite incremental progress in legal configuration for the Xinjiang FTZ,institutional supply remains generally lagging and inadequate,failing to meet the reform demands of the zone.Over the past decade,China's FTZ legal development has crystallized a distinct model centered on "legal and regulatory adjustments+regional regulations + supporting normative documents",forming a socialist legal framework with Chinese characteristics.These precedents offer valuable insights for Xinjiang's FTZ legal system construction.Following this practical logic,Xinjiang should comprehensively build a diversified legal framework prioritizing "legal and regulatory adjustments",anchored by the China(Xinjiang) Pilot Free Trade Zone Regulations,and supplemented by "supporting normative documents".Additionally,Xinjiang should proactively seek national-level "authorization for local legislative adaptability" to unlock development potentials aligned with its unique conditions,actively align with international high-standard trade and economic rules,and pioneer new pathways for advancing China's high-level opening—up.
