摘 要:粤港澳大湾区三地民航法治合作的障碍主要源于立法、行业监管等方面的差异与法律冲突。结合民航高度的国际化特征,在对区际法治合作既有模式样本进行考察的基础上,可以基于三地法律文化的共通性以及对航空安全的共识,消除法域和法系隔阂,将大湾区“一国两制三法域”的制度差异转变为发展优势,探索建立大湾区民航法治合作的基础,从构建大湾区民航法治合作的多元立法模式、建设区域协调机制和构建民航法治联合体等方面,提出促进粤港澳三地民航法治合作的路径设想。The obstacles to legal cooperation in civil aviation among Guangdong,Hong Kong and Macao are mainly due to differences and legal conflicts in legislation and industry supervision.Given the highly international nature of civil aviation,we can eliminate the gap between jurisdictions and legal systems by investigating the existing model samples of interregional legal cooperation and drawing on the commonality of legal culture and the consensus on aviation safety in the three regions.The institutional differences,under the framework of“one country,two systems and three jurisdictions”in the Greater Bay Area,can be transformed into developmental advantages to establish the foundation for legal cooperation in civil aviation.This paper suggests pathways for promoting such cooperation among Guangdong,Hong Kong and Macao through building a diversified legislative model of legal cooperation in civil aviation,a regional coordination mechanism,and a legal consortium of civil aviation in the Greater Bay Area.
